DEFERRED ACTION for CHILDHOOD ARRIVALS (DACA)

IMPORTANT- If you are less than 18 years of age YOU SHOULD APPLY FOR DACA BEFORE YOU TURN 18!!! Once you turn 18 and have not received DACA, you begin to accrue unlawful presence and are subject to the 3-year and 10-year bar to admissibility.

You may request DACA:

1) If you were under the age of 31 on June 15, 2012 AND

3) You resided in the United States continuously since June 15, 2007, up to the present time AND

2) You came to the United States before you were 16 AND

4) You were in the United States on June 15, 2012 and when you make your request for DACA AND

5) You did not have legal status on June 15, 2012, AND

6) You are in school, graduated high school, obtained a GED, or were honorably discharged from the Armed Forces, AND

7) You have not been convicted of a felony, significant misdemeanor, or three or more other misdemeanors, and do not otherwise pose a threat to national security or public safety.

If you qualify for DACA, you may be eligible to work.

DACA is not an act of Congress. The legislative branch of government has not passed the DREAM Act. DACA is an act of prosecutorial discretion by the executive branch of government. It may be revoked at any time.
